General Terms and Conditions

1. Scope
The following terms and conditions apply for all orders via our online shop.

2. Contractor, Customer Service
The purchase takes place with the Sonnen-Apotheke, Emmerich am Rhein; Germany. Further information about us can be found in the "imprint". You can contact our customer service for questions, claims and complaints by calling 0049 (0) 2822 4885

3. Contract conclusion
The presentation of products in our online shop is not a legally binding offer, but a non-binding online catalogue. By clicking the "buy now" button you enter a binding order for the goods in the shopping cart. The confirmation of the order follows immediately after sending the order and does not constitute an acceptance of the contract. We can accept your order by sending an order confirmation via e-mail or by delivering the goods within 4-7  workingdays, unless the contract depends on the occurrence of further conditions (for example, the presentation of a prescription). In this case, an acceptance of the contract is declared within 5 days from the occurrence of the condition.

In order to prevent drug abuse, Eumed reserves the right to reduce order quantities and, in case of reasonable suspicion of abuse, to not execute orders at all despite order confirmation via e-mail. This relates to pharmaceuticals, e.g. inter alia, painkillers, laxatives, sleeping pills, as well as potentially dangerous classifiable products (e.g. chemicals).
Prescription drugs will be sent only if the doctor's prescription in the original is submitted.
If you have chosen the payment method PayPal, the contract is concluded in all cases at the time of confirmation of the payment order by the payment services provider.

4. Shipping costs
Shipping costs are added to the stated product prices. For details on the amount of shipping, please consult the offers.

5. Payment
Payment is made by prepayment, cash on delivery, PayPal, per invoice or Sepa Direct Debit( only for clients from Germany)

When choosing this payment method a charge of seperate costs.
If you pay the invoice amount via the online providers Paypal, you must be generally registered there or must first register, legitimise with your login data and confirm the payment instruction to us (except possibly as guest access). Further information is available during the ordering process.

6. Cash payment at customer collection
You generally have the option of pick up personaly the products at the Sonnen-Apotheke, Kleiner Löwe 8, 46446 Emmerich, Germany, during the business hours specified below: Monday to Friday 8.30am to 6.00pm and Saturday 8.30am to 1.00pm

7. Retention of title
The merchandise remains property of Sonnen Apotheke until full payment.

8. Cancellation
The following is an instruction about the conditions and consequences of the legal right of revocation for delivered orders.

Cancellation Policy

Cancellation Right
You are entitled to rescind from this contract within 14 days and without having to give any reasons. The cancellation period shall be 14 days as from the date you or any third party respectively authorized by you (except for the carrier) have or has taken possession of the goods.
In order to exercise your cancellation right, please inform us (sonnen-apotheke, Kleiner Löwe 8, D-46446 Emmerich, Germany, phone: 0049-2822-4885, fax: 0049-2822-4844, e-mail: sonnen@apotheke-emmerich.de) on your decision to do so by means of an explicit declaration (e.g. by postal mail, fax, or e-mail). If requested, you can also use the attached cancellation sample form for this purpose.
The cancellation period shall be observed if you submit the letter, fax, or e-mail stating your intent to exercise your cancellation right within the above period.   

Consequences of Cancellation
If you rescind from this contract we shall have to immediately refund any and all payments received from you plus the related delivery costs (excluding extra fees resulting from your decision to opt for a delivery mode more expensive than the standard delivery offered by us) and do so no later than 14 days as from the date on which we received your respective information.  Suchlike refunds will be realized using the same payment method as for the original transaction, unless explicitly agreed with you otherwise. However, you shall generally not be charged any fees for suchlike refunds. We shall be entitled to suspend the refund until we have received the goods returned or until you have furnished proof of returning the goods, depending on which is earlier.
You shall have to return respective goods immediately and generally no later than 14 days as from the date on which you informed us on your intent to rescind from this contract. The return period shall be met if you post the goods within 14 these days. You shall bear the direct costs resulting from returning the goods. You shall only have to compensate us for any depreciation of the goods if the respective loss in value is caused by you treating the goods in a way and manner that can damage or modify their quality, properties, and functionality.

10. Contract Language
The language available for the contract is German.

11. Notice concerning battery legislation
Since batteries may be included in our deliveries, pursuant to the Battery Act (BattG) we are obliged to draw your attention to the following: batteries must not be disposed of in household waste, used batteries and accumulators are legally obliged to be returned. Old batteries can contain harmful substances that can harm the environment or your health through improper storage or disposal. Batteries also contain important raw materials such as iron, zinc, manganese or nickel and can be recycled. You can either return batteries free of charge to us after use or in the immediate vicinity (e.g., commercial businesses or in municipal waste disposal centres or at our dispatch warehouse).
Delivery to commercial businesses is limited to end-users for the usual amounts and those batteries which the distributor has or has had as new batteries in its range of products.
